Welcome to Siyagh! The terms "we", "us" and "our" refer to Siyagh. Siyagh operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Siyagh is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree, you should not use or access our Services.

Section 1 — Access and Account

By agreeing to these Terms, you represent that you are at least 18 years of age, or are using the Services under the supervision of a parent or legal guardian.

To use the Services, including browsing or purchasing products, you may be asked to provide information such as your name, phone number, email address, and delivery address. You represent that all information you provide is correct, current, and complete.

You are solely responsible for the security of your account credentials and all activity under your account.

Section 2 — Our Products

We make every effort to accurately represent our unstitched fabric products, including color, texture, and fabric type. However, actual color and texture may vary slightly from what appears on your screen due to device display settings, lighting, and photography conditions.

All product descriptions, fabric compositions (Cotton, Wash n Wear, Boski, Karandi, Lawn, Cambric, Khaddar), and prices are subject to change at any time without prior notice. We reserve the right to discontinue any product or limit quantities available for purchase.

Fabric length listed (e.g. 4.5 meters per suit) is approximate and may vary by a small margin due to manufacturing tolerances.

Section 3 — Orders

When you place an order, you are making an offer to purchase, which Siyagh may accept or decline at its discretion (for example, in cases of stock unavailability, pricing errors, or suspected fraudulent orders).

For Cash on Delivery (COD) orders: Your order is confirmed once you complete checkout. We may contact you via phone/WhatsApp to verify the order before dispatch. Repeated refusal of COD orders without valid reason may result in future orders from the same number/address being declined.

Orders are subject to our Refund Policy.

You confirm that purchases are for personal or household use and not for commercial resale, unless otherwise agreed with us in writing.

Section 4 — Prices and Billing

All prices are listed in Pakistani Rupees (PKR) and are inclusive/exclusive of delivery charges as indicated at checkout. Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as confirmed at checkout.

For Cash on Delivery orders, payment is collected in cash (or via approved digital wallet, if offered) at the time of delivery. You agree to have the correct payment amount ready upon delivery.

Section 5 — Shipping and Delivery

We deliver across Pakistan through third-party courier services. Estimated delivery times are provided for guidance only and are not guaranteed. We are not liable for delays caused by courier services, weather conditions, regional disruptions, public holidays, or other events beyond our control.

Please ensure your delivery address and contact number are accurate. Siyagh is not responsible for failed deliveries due to incorrect address/contact information provided by the customer.

Section 6 — Intellectual Property

All content on this Services — including the Siyagh brand name, logo, product photography, descriptions, and design — is owned by Siyagh and protected under applicable Pakistani copyright and trademark law, including the Copyright Ordinance, 1962 and the Trade Marks Ordinance, 2001.

You may not reproduce, copy, distribute, or use our branding, product images, or content without our prior written consent.

Section 7 — Optional Tools

The Services may provide access to tools operated by third parties (such as payment processors or courier tracking systems) which we do not control. Use of such tools is at your own risk and subject to the third party's own terms.

Section 8 — Third-Party Links

The Services may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party site, and accessing them is at your own risk.

Section 9 — Relationship with Shopify

Siyagh is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases made through this store are made directly with Siyagh, not Shopify. Shopify is not responsible for any aspect of sales between you and Siyagh, including any injury, damage, or loss resulting from purchased products.

Section 10 — Privacy Policy

Your personal information is collected and processed in accordance with our Privacy Policy, consistent with applicable Pakistani data protection principles under the Electronic Transactions Ordinance, 2002 and the Prevention of Electronic Crimes Act (PECA), 2016. Certain personal information may also be processed by Shopify as our service provider.

Section 11 — Feedback and Reviews

If you submit reviews, feedback, or suggestions, you grant Siyagh a non-exclusive, royalty-free license to use, reproduce, and display such content for business and marketing purposes. You confirm that your feedback is truthful, lawful, and does not infringe on any third party's rights.

Section 12 — Errors, Inaccuracies and Omissions

Occasionally the Services may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, or availability. We reserve the right to correct such errors and to cancel affected orders, even after an order has been placed, without prior notice.

Section 13 — Prohibited Uses

You agree not to use the Services for any unlawful purpose, including but not limited to violations of the Prevention of Electronic Crimes Act (PECA), 2016, or to:

Transmit false, fraudulent, or misleading information (including placing fake or fraudulent COD orders)
Harass, abuse, or defame Siyagh, its employees, or other users
Attempt to interfere with, hack, or disrupt the Services
Use automated bots, scrapers, or AI agents to access the Services without authorization
Infringe on Siyagh's intellectual property or that of any third party

We reserve the right to suspend or terminate access to any user found engaging in prohibited conduct, including blacklisting phone numbers/addresses associated with repeated fraudulent COD refusals.

Section 14 — Automated Agents

No automated software or AI agent may access, use, or place orders through the Services on a person's behalf unless it clearly identifies itself as an automated agent and complies with any technical restrictions we have put in place.

Section 15 — Termination

We may suspend or terminate your access to the Services at our sole discretion, without notice, particularly in cases of suspected fraud, abuse, or repeated violation of these Terms.

Section 16 — Disclaimer of Warranties

The Services and all products are provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted under applicable Pakistani law. We do not guarantee that the Services will be uninterrupted, timely, or error-free.

Section 17 — Limitation of Liability

To the fullest extent permitted by law, Siyagh, its owners, employees, and affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services or products purchased, including but not limited to loss of profit or data, except where such limitation is not permitted under Pakistani consumer protection law.

Section 18 — Indemnification

You agree to indemnify and hold harmless Siyagh, its owners, employees, and affiliates from any claims, damages, or liabilities (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services.

Section 19 — Severability

If any provision of these Terms is found unlawful or unenforceable under applicable law, that provision will be severed, and the remaining provisions will continue in full force and effect.

Section 20 — Entire Agreement

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Siyagh regarding use of the Services, superseding any prior communications or agreements.

Section 21 — Assignment

You may not transfer or assign your rights under these Terms without our written consent. We may assign or transfer these Terms without restriction.

Section 22 — Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Karachi Pakistan.

Headings used in this agreement are for convenience only and do not affect interpretation of these Terms.

Section 24 — Changes to Terms of Service

We reserve the right to update or change these Terms at any time by posting the revised version on this page. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
